Questions on the new FADP
The questions Swiss SMEs really ask, each with the answer in a few lines and the articles of the law. For the FADP and, where it applies, the GDPR.
Does it apply to us?
- Does the new FADP apply to my SME?Yes, to every business that processes data on people, whatever its size.
- Revised FADP and GDPR: what are the differences, and when do both apply?Similar principles, different rules on legal basis, deadlines and sanctions.
- What sanctions does the new FADP provide for, and on whom?Fines up to CHF 250,000 on the responsible individual, for wilful breaches.
Documents and roles
- Is a record of processing activities required under the new FADP?Yes, as a rule; below 250 employees it depends on the risk.
- Do I have to appoint a data protection officer (DPO)?Under the FADP no, it is optional; under the GDPR sometimes yes.
- What must a privacy notice contain? At least who you are, why you process data, who gets it and where it goes.
- Is a data protection impact assessment (DPIA) required?Only for processing that may result in a high risk.
Vendors and abroad
- Can I use vendors with servers in the United States or the EU?Yes: to the EU freely, to the US with the Data Privacy Framework or safeguards.
- Do we need a contract with vendors that process data for us?Yes, with anyone who processes data on your behalf (Art. 9 FADP).
- Cookies and banners: is consent required in Switzerland? As a rule, informing and allowing refusal is enough; under the GDPR consent is needed.
